Data provision - Terms and Conditions

1. Introduction

1.1 These terms and conditions shall govern the provision of Data and must be read in conjunction with our general Terms and Conditions listed at the foot of the home page of our website (www.dialdirect.co.za).
1.2 By accepting these terms and conditions you consent to us sharing your personal information with the respective Data and network service providers.

2. Registration and activation

2.1 To be eligible for any Data provision, you will be required to perform certain activities and comply with certain rules. These terms and conditions are outlined in sections 5 and 6 respectively. 
2.2 You shall not allow any other person to use your account to conduct these activities to earn your Data.
2.3 You must notify us in writing immediately if you become aware of any unauthorised use of your account.

3. User IDs and passwords

3.1 Should you register for an online profile on our website, you will be asked to confirm your user ID and password.
3.2 Your user ID must comply with the content rules set out in the general terms and conditions of the website. You must not use your account or user ID for or in connection with the impersonation of any person or for any fraudulent reasons. 
3.3 It is your responsibility to at all times keep your user ID and password secret and confidential.
3.4 If you become aware of any misuse of your password by any other person, you must immediately change your password and notify us.
3.5 You are responsible for any activity on our website arising out of any failure to keep your password confidential, and may be held liable for any losses arising out of such a failure.

4. Data

4.1 In these terms and conditions Data will refer to:
4.1.1 Mobile Data; or
4.1.2 Wi-Fi Data. 
4.2 We will not accept liability for any act, failure or omission by any network or any third party supplier for the provision of the Data. Should there be any dispute, relevant and reasonable steps needs to be taken to inform the relevant parties of such dispute at the contact details listed on the website. 

5. Data provision

5.1 New policyholders who purchase a Dialdirect insurance policy after the 12th of February 2016 will be eligible for either Mobile Data or Wi-Fi Data, but not both. New policyholders will have thirty (30) days from date of purchase of their Dialdirect policy to earn and use the Data, failing which the Data will be forfeited in totality without recourse or claim of any which type or form whatsoever.
5.2 Existing Dialdirect policyholders with an active policy at 12 February 2016 will only be eligible for Wi-Fi Data.
5.3 The provision of Data will only be linked to one online profile, irrespective of the number of policies held by the policyholder.
5.4 In the event that the policyholder is unable to receive or use the Data, the policyholder may nominate family members or members of the household registered on the active policy to receive or use such Data.
5.5 Data will be provided on a once-off basis in the amount of 500MB, unless expressly otherwise stated. We reserve the right to change the Data amount, allocation, and distribution rules at any time without prior notice at our own discretion.
5.6 Data will only be provided upon completion of all of the following activities:
(a) Activation of the policyholder’s online profile by logging on and confirming your password; and
(b) By verifying certain risk and account information so that we are able to better underwrite your risk profile and to ensure that you are insured correctly. 
(c) In the event where you are an existing policyholder and you have already activated your online profile, you will only be required to complete the activity described in (b) above. All other terms and conditions will however still apply.

6. Data provision is subject to rules

6.1 Data provision is limited to customers of the following cellular service providers only:
6.1.1 Vodacom;
6.1.2 MTN; 
6.1.3 Cell C; and 
6.1.4 Telkom.
6.2 Most networks do not allow the provision of Data to certain types of contracts; however prepaid and/or top-up customers are compatible. This will be network dependant and will need to be verified with the respective networks. We have however catered for this in the form of Wi-Fi Data and the option to send the Data to household members who are prepaid and/or top-up customers. 
6.3 We will not enter into any dispute regarding the failure and/or disallowance of Data provision to certain networks and/or contracts, for any reason whatsoever. 
6.4 The expiry of Data is set by the service provider unless specifically stated elsewhere. In general, Mobile Data lapses after thirty (30) days after activation and does not carry-over unless otherwise stated. Wi-Fi Data, unless otherwise stated, will be valid for (12) twelve months after activation or acceptance. We reserve the right to change, where in our control, the allotted time for Data to be active and usable, and may, without prior consultation and as we see fit, reduce or increase the time of allocation and/or usability of Data.
6.5 Data will only be provided and be valid for use on South African networks supported by the local and/or international rules that govern these networks.

7. Third party rights

7.1 A contract under these terms and conditions is for our benefit and your benefit, and is not intended to benefit or be enforceable by any third party.
